Terms & Conditions
These Terms & Conditions (the “Terms”) govern your use of the Gut Garden mobile app and the website gutgarden.app (together, the “Service”). By creating an account or using the Service you agree to these Terms and to the Privacy Policy. If you do not agree, please do not use the Service.
1. Who we are
The Service is operated by Márton Takács, a private individual based in Hungary (“we”, “us”). Contact: hello@gutgarden.app.
2. What the Service is
Gut Garden is a habit tracker for gut-friendly eating. Each day you answer five short questions about what you ate; the app computes a daily score, tracks streaks and statistics, lets you optionally tag foods, and offers short educational articles.
3. Eligibility and your account
- You must be at least 16 years old (or the age of digital consent in your country) to use the Service.
- You need an account (email address and password) to use the app. Keep your credentials confidential; you are responsible for activity under your account.
- Provide accurate information and tell us if you believe your account has been compromised.
4. Price
The Service is currently free of charge. If we ever introduce paid features, we will announce them clearly in advance; nothing will be charged without your explicit agreement.
5. Acceptable use
When using the Service you agree not to:
- break any applicable law;
- probe, disrupt or overload the Service or attempt to access other users' data;
- reverse engineer the Service except where the law expressly permits it;
- use the Service to build a competing dataset by automated means.
6. Your content and our content
- Your data stays yours. You retain all rights to the information you log. You grant us only the limited licence needed to store and process it in order to run the Service for you, as described in the Privacy Policy.
- The Service itself — its software, design, text, articles and branding — is our intellectual property or that of our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app for your own private, non-commercial use.
7. Availability and changes to the Service
We provide the Service free of charge and aim to keep it available and working well, but we cannot guarantee uninterrupted or error-free operation. We may improve, change or discontinue features. If we ever decide to shut the Service down entirely, we will give reasonable advance notice so you can export your data.
8. Termination
- By you: you can stop using the Service and request deletion of your account at any time by emailing hello@gutgarden.app.
- By us: we may suspend or terminate accounts that materially breach these Terms, after warning you where reasonable.
9. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for damage caused intentionally or by gross negligence, or for harm to life, physical integrity or health.
Subject to that, and given that the Service is provided free of charge: the Service is provided “as is”; we are not liable for indirect or consequential losses, loss of data caused by events outside our reasonable control, or your reliance on the Service for health decisions (see the Disclaimer).
If you are a consumer in the EU/EEA, you always keep the rights that the consumer-protection law of your country of residence gives you — these Terms never reduce them.
10. Changes to these Terms
We may update these Terms, for example when we add features or the law changes. We will post the new version at this URL and update the effective date; for material changes we will notify you in the app in advance. If you keep using the Service after a change takes effect, the new Terms apply. If you do not agree with a change, you can stop using the Service and delete your account.
11. Governing law and disputes
These Terms are governed by the laws of Hungary. If you are a consumer residing in another EU/EEA country, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in your own country.
The European Commission provides an online dispute resolution platform: ec.europa.eu/consumers/odr. We prefer to resolve things directly — email us first and we will do our best to sort it out.
